Terms of Service

1. Provider

BiteNote is a YesWas product, operated by YesWas | Paweł Orzech (Polish jednoosobowa działalność gospodarcza, sole proprietorship), NIP PL8741734171, registered in CEIDG, Republic of Poland. Contact: [email protected]. (Registered address is disclosed on issued VAT invoices and on request.) These terms apply to use of the Telegram bot @bitenotebot and the website bitenote.eu.

2. What BiteNote is

BiteNote is an informal calorie-and-macro estimator. It uses AI vision and audio models to produce ranges of estimated calorie and macronutrient values from food photos, voice notes, and text. Ranges — not single numbers — are intentional: estimates from photos are inherently uncertain. BiteNote is not a medical device, not clinical nutrition advice, and not a substitute for professional care. Do not use BiteNote for clinical decisions, eating-disorder treatment, or any setting requiring medical precision.

3. Eligibility

You must be at least 18 years old. By tapping the consent button on first use, you confirm your age and that you have read the eating-disorder warning.

4. When the contract is concluded

A paid contract is concluded when (a) Telegram confirms a successful Stars purchase, or (b) Stripe confirms a successful Checkout session. Use of the free tier does not create a paid contract but is still subject to these terms.

5. Pricing and plans

PLN prices include 23% VAT where applicable. Price changes apply only to new purchases or future renewals; current paid periods are unaffected.

6. Payment methods and renewal

A Polish VAT invoice (faktura VAT 23%) can be requested by emailing [email protected] with your payment reference, billing name, address, and NIP for business buyers. Invoices are issued via infakt.pl.

7. Right of withdrawal and refund (EU consumers)

Under the Polish Act on Consumer Rights of 30 May 2014 (UoPK) implementing EU Directive 2011/83/EU, you have a 14-day right of withdrawal from distance contracts. BiteNote is a digital service delivered electronically. Before each paid purchase, the bot displays a consent screen on which you must tap "I agree, charge me" — by tapping it, you (i) ask us to begin performance immediately, and (ii) acknowledge that your right of withdrawal is lost once the service has been performed in full (UoPK art. 38 pkt 13). After payment, we send you a confirmation message in @bitenotebot which serves as the durable-medium record of this consent (UoPK art. 21 ust. 1).

Goodwill refund (in addition to your statutory rights): if you have not used any estimations from the purchased subscription period, contact [email protected] within 48 hours and we will refund you in full. This goodwill offer does not waive any mandatory consumer rights you may have.

8. Cancellation and changes to subscriptions

Stars subscriptions simply expire at the end of the purchased period — no cancellation action is needed.

Stripe subscriptions renew automatically until cancelled. Cancel via /account → cancel in the bot or via the Stripe Customer Portal (linked in your receipt email and in /account). Cancellation sets the subscription to end at the close of the current paid period; access continues until that date. We do not pro-rate refunds for unused days within an already-paid cycle, except as required by mandatory law or under the goodwill offer above.

9. Acceptable use

We may suspend or terminate access for material breach. We will give reasons in writing where reasonably possible.

10. Service availability

The service is provided on a best-effort basis. We do not guarantee a specific uptime. The bot uses polling, so brief interruptions during deployments are normal. There is no SLA. Where reasonably practicable, planned maintenance is announced in @bitenotebot.

11. Changes to the service or terms

For changes that materially reduce your rights or increase your obligations, we will give at least 30 days' notice via bot message. If you do not accept the changes, you may terminate the contract before the effective date and we will refund any prepaid unused period.

12. Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising from your use of BiteNote is limited to the amount you paid in the 30 days preceding the claim. This limitation does not apply to: liability for death or personal injury caused by negligence; liability for fraud; wilful misconduct or gross negligence; and any other liability that cannot be excluded under EU or Polish mandatory law (in particular, mandatory consumer-protection rules).

13. Complaints (reklamacje)

Complaints may be sent to [email protected]. We aim to respond within 14 days. If we do not respond within 14 days, the complaint is deemed accepted (UoPK art. 7a).

14. Out-of-court dispute resolution

The EU Online Dispute Resolution (ODR) platform was decommissioned on 20 July 2025 (Regulation (EU) 2024/3228). EU consumers in Poland may use the following alternatives instead: the permanent consumer arbitration courts (stałe sądy polubowne) at the regional Trade Inspectorates (Wojewódzkie Inspektoraty Inspekcji Handlowej, uokik.gov.pl); the Consumer Ombudsman (powiatowy / miejski rzecznik konsumentów); and the Office of Competition and Consumer Protection (UOKiK). Use of these procedures is voluntary and does not waive your right to court proceedings.

15. Governing law and jurisdiction

These terms are governed by Polish law. For consumers, the mandatory consumer-protection rules of your country of habitual residence in the EU continue to apply and are not displaced by this clause. For non-consumers, the courts of Warsaw, Poland have exclusive jurisdiction.
